For example, when Butler comments that '[t]he resolution of the Oedipal complex affects gender identification through not only the incest taboo, but, prior to that, the taboo against homosexuality' (1990b, 63; emphasis added) she posits an identity that pre-exists its formation. By uncritically assuming a temporal development whereby primordial conditions (and identities) are only later interrupted, prohibited and transformed by culture's dictates, Butler seems to sacrifice the more persuasive and radical provocations that her argument has established; indeed, it might be said that she falls prey to the same naive foundationalism that she criticizes in Wittig.

To this end, a more sustained analysis of her understanding of 'language', arguably the key to her entire oeuvre, will be explored in the next section. At this juncture, however, and as part of the summation 46 Judith Butler: Live Theory of Gender Trouble's accomplishment, the more problematic aspects of the argument will simply be noted. It is perhaps ironic that Butler's stated intention to reconfigure power as a productive, generative and perverse force is hobbled by an enduring and overriding commitment to power's juridical identity and repressive 'psychology'.

The most troubling concern that emerges in this concluding section then, and it mirrors an organizational fault line that runs through Gender Trouble, is whether a Foucauldian understanding Gender, Sexuality, Performance - Gender Trouble 47 of power can be made compatible with a psychoanalytic one. Butler's 'performative polities' assumes that the law must continually repeat itself in order to reinstantiate itself as a fixed, foundational truth: the will to repeat is a will to stabilize identity.
